The FDA's TPL review states in footnote 4: "Due to added ingredients such as sweeteners and cooling agents, FDA has determined that all new products have a non-tobacco characterizing flavor." The reviewer noted the applicant called Smooth and Chill "flavored" in some parts of its applications and "unflavored" in others. Chill's cooling agent was "at least 5 times higher" than the 100 ppm level reported to produce cooling. The sweetener in both ran 39 to 77 times above recognition level.

Jabba et al. were more direct: the study authors concluded that the manufacturer's advertising of these products as "Flavour-Ban Approved" or "unflavoured" was "misleading." State flavor bans hinge on the word "flavored," so this classification matters.

Why Was Zyn Chill Banned in Massachusetts?

Massachusetts banned retail sale of flavored tobacco under M.G.L. c. 270, § 28, signed November 2019, with menthol restrictions from June 1, 2020. The law defines "characterizing flavor" as "a distinguishable taste or aroma, other than the taste or aroma of tobacco," and treats manufacturer flavor statements as "presumptive evidence."

No single statewide order pulled these products. Local boards applied the existing law after FDA classified both as flavored:

  • March 2026: The Central Massachusetts Regional Health Department ordered 39 businesses in Shrewsbury, Grafton, and West Boylston to stop selling Zyn Chill and Zyn Smooth (3 mg and 6 mg).
  • Separately: Needham's Board of Health has moved to bar Chill and cap nicotine pouch strength at 6 mg.
  • July 2026: Peabody retailers were fined at least $1,000 each for selling Zyn Chill.
