Can Pilots Take Caffeine Pills? FAA Rules, DoD Policy, and the Pouch Question

Can pilots take caffeine pills and still fly legally? No FAA regulation sets a caffeine limit for pilots. Caffeine is not on the DOT drug-testing panel. What the FAA does regulate is fitness: 14 CFR 61.53 bars flying with a known disqualifying medical condition, and 14 CFR 117.5 requires Part 117 flightcrew to report rested and to affirmatively state they are fit for duty. Neither section mentions caffeine by name.

Below is what federal regulation, FAA guidance, and DoD policy actually say, cited to the source documents.

The Two Federal Rules That Govern a Fatigued Pilot

14 CFR 61.53: Medical Deficiency

The rule bars a pilot from flying while knowing of any medical condition that would make them unable to meet certificate requirements, or while taking medication that produces the same result. For BasicMed operations under 61.23(b), paragraph (b) puts it more broadly: a person shall not act as PIC or required crewmember "while that person knows or has reason to know of any medical condition that would make the person unable to operate the aircraft in a safe manner."

The word "caffeine" does not appear.

14 CFR 117.5: Fitness for Duty

This rule applies to Part 117 operations (scheduled air carriers under part 121). It requires each flightcrew member to report for duty rested (a), bars both the certificate holder and the flightcrew member from accepting or continuing an assignment when the member has reported too fatigued (b, c), and requires each member to "affirmatively state he or she is fit for duty prior to commencing flight" at dispatch (d).

No caffeine limit. The regulation puts the burden on self-certification and the operator's fatigue-risk framework.

14 CFR 91.17: Alcohol or Drugs

91.17(a) prohibits acting as a crewmember while "using any drug that affects the person's faculties in any way contrary to safety." Whether caffeine could fall under that standard is a judgment the regulation leaves open. It does not name caffeine.

What the FAA Tells Pilots About Caffeine Directly

The FAA's Civil Aerospace Medical Institute published a pilot safety brochure titled "Fatigue in Aviation" (publication OK-20-0925, dated 04-29-2020). Its guidance is brief:

  • Don't: "Consume alcohol or caffeine 3-4 hours before going to bed."
  • Do: "When needed, and if possible, nap during the day, but limit the nap to less than 30 minutes. Longer naps produce sleep inertia, which is counterproductive."

The brochure also lists "excessive alcohol or caffeine use" among the behavioral contributors to fatigue. That is the extent of formal FAA pilot-facing caffeine guidance found in the documents reviewed here.

A 2023 meta-analysis in Sleep Medicine Reviews (Gardiner et al.) found that to avoid reductions in total sleep time, coffee at roughly 107 mg per 250 mL should be consumed at least 8.8 hours before bedtime. The Advisory Circular People Misattribute

AC 120-115, "Maintainer Fatigue Risk Management," is often cited as FAA pilot guidance on caffeine. It is not. The AC is dated 12/2/16, initiated by AFS-300, and it is written for aviation maintenance organizations and individual maintainers. It says on its face: "This AC is informational and is not mandatory. It does not constitute a regulation."

The pharmacology in paragraph 9.1.5 is sound: caffeine has a half-life of around 5 hours, shift workers should avoid it before sleep, and "caffeine is less effective as an alerting agent for people who have developed caffeine dependence" (citing Mitler and O'Malley, 2005). The one exception: caffeine taken immediately before a brief nap, since the alerting effects take roughly 30 minutes to arrive, leaving a window for rest.

What the DOT Drug Test Actually Screens For

The 49 CFR 40.85 analyte list covers marijuana metabolites, cocaine metabolite, opioids (codeine, morphine, hydrocodone, hydromorphone, oxycodone, oxymorphone, 6-acetylmorphine), phencyclidine, amphetamine/methamphetamine, and MDMA/MDA.

Caffeine is not on it. Nicotine is not on it either. Both statements cover the federal panel only; individual employers may test beyond it.

The Military Side: A Different Regime

DoD operates under flight-surgeon supervision. The OPSS page on stimulants for flight crew alertness states:

OPSS notes that "all services support and encourage the use of caffeine before Go Pills."

These figures apply to military aircrew under flight-surgeon supervision. They are quoted here for context, not as a suggestion. For anyone reading this as a consumer, the FDA's reference is 400 mg a day as the amount "not generally associated with negative effects" for most adults.

The Nicotine Pouch Question

14 CFR part 252 bans smoking on flights. Section 252.3 defines smoking as "the use of a tobacco product, electronic cigarettes whether or not they are a tobacco product, or similar products that produce a smoke, mist, vapor, or aerosol." A pouch produces none of those, so the federal smoking rule does not reach it on its face.

Carrier policy is separate. Delta's Contract of Carriage Rule 10 states: "Delta prohibits smoking and the use of all smokeless tobacco products (including e-cigarettes and vapes) on all flights." Whether a non-tobacco pouch falls inside that language is Delta's call. Other carriers have their own policies.

The answer for any pilot: check your operator's policy. No federal rule reviewed here settles whether a pouch, nicotine or otherwise, is permitted on a given flight deck.

Kamimori et al. (2002) found that caffeine gum reached peak plasma concentration faster than capsules (mean Tmax 44 to 80 min vs. 84 to 120 min), suggesting buccal mucosal absorption.

What the FAA's Fatigue Science Says About Relying on Caffeine

The 2024 FAA Scientific Expert Panel report on air traffic operations is written for controllers, not pilots, but its fatigue science applies broadly. Caffeine blocks adenosine and can improve alertness "without reducing sleep debt," meaning sleep pressure keeps accumulating and "returns harder" as caffeine clears. The report's conclusion: "Sleep is the best remedy for the sleep loss that results from shiftwork schedules. Other countermeasures (e.g., caffeine and activity breaks) do not provide the same level of benefits or lasting effects as sleep."

Caffeine masks adenosine pressure. It does not erase it.

Conclusion: Rest, Self-Certification, and the Limits of Any Stimulant

The regulatory framework puts responsibility on the individual crewmember (61.53, 117.5) and the operator's fatigue risk management program. Controlled rest, where an operator's approved program provides for it, is a recognized countermeasure for long-haul operations. Self-certification at dispatch under 117.5(d) means the pilot, not a substance, is the last checkpoint.
